Laborer was severely injured while working on a scaffolding in new construction at a local hospital. Stacking the scaffolding with new brick for the brick layers, the laborer suddenly lost his balance and fell over 20 feet, suffering multiple fractures and a hematoma to his back side.

Investigation revealed that the scaffolding had been improperly erected by the local scaffolding company. During the construction process the scaffolding was erected without safety guardrails, as required by various codes, to protect workers from falling in the event they are unable to maintain his or her balance.

The case was eventually resolved just prior to trial after a long discovery process that included over 15 depositions, as well as the preservation of several physicians’ testimony for trial. The settlement amount was 1.25 million dollars.
