Plaintiff, age 69, was treated by a dermatologist and a urologist for a penile lesion. These Defendants ordered a biopsy which was misread as negative by the pathologist. The dermatologist and urologist should have re-biopsied after one year’s time when the lesion didn’t go away. The Defendants argued that the standard of care did not require that the lesion be re-biopsied. Plaintiff suffered a penilectomy as a result.
