Family Receives $8.5 Million after Traumatic Birth Injury
After 15 hours of deliberation, a Cuyahoga County Common Pleas jury decided MetroHealth Medical Center should pay a mother $8.5 million after her child suffered a permanent birth injury. The child, who is now 3 years old, is tube-fed and will require lifelong care. Upon birth, the infant was not breathing—and the head obstetrics nurse waited five minutes before calling the hospital’s Code Pink neonatal resuscitation experts. The defendant argued that the injury was caused by a placental infection, but a forensic documents examiner testified the infant’s test results shortly after birth were altered to justify a lack of immediate resuscitation.
