When a person is killed as the result of another’s negligence, the family of the victim may have a right to seek compensation, through civil litigation, from the party responsible for their loss. The Ohio Wrongful Death Attorneys with Nurenberg, Paris, Heller & McCarthy explain two such cases were recently filed in an Ohio court following a drowning accident at an apartment complex.

According to an article from 10 TV News, the incident occurred this past February at the Hartford at the Lake apartment complex located on Shore Boulevard in Columbus, Ohio. Reports indicate a 5-year-old boy somehow made his way into the icy water and was soon encompassed by the freezing liquid. Witnesses called for assistance and a bystander jumped into the pond in an effort to rescue the boy; however, the freezing temperatures of the water soon overwhelmed him too.

Emergency crews were able to pull both victims from the water, but they died as a result of the exposure they suffered. This past Friday, the families of the victims filed suit against the apartment complex, saying their negligence in failing to fence off the area or warn residents of the dangers the pond posed was directly responsible for their loss. This was the sixth fatal event to occur at the pond since 1998.

The Ohio Personal Injury Lawyers are hopeful a decision in the recently filed case will bring closure to the incident for the families of the victims.
