Birth Trauma Results in $4 Million Settlement
Case Summary:
Amount: $4,000,000Court: Summit County Court of Common Pleas
Date: March 2002
Plaintiff's Counsel: William S. Jacobson, David M. Paris
Description: Medical Malpractice
Plaintiff’s mother presented to the defendant hospital at 36 weeks gestation with vaginal bleeding. The fetal heart monitor showed bardycardia, then stabilized. She was then observed for 2 hours and then a C-section was performed. Plaintiff alleged that the health care providers failed to recognize the signs and symptoms of a uterine abruption and that the earlier failure to mobilize delayed the C-Section. This resulted in the baby being born with mild mental retardation and cerebral palsy.
