Personal Injury Lawsuit Process
When your personal injury case is in the negotiation phase, this is known as pre-litigation. If you reject the other party’s settlement offers and decide to file a lawsuit, your case moves into the litigation or trial phase.
The Ohio personal injury lawyers at Nurenberg, Paris, Heller & McCarthy can help you through the litigation process. We have years of experience as trial lawyers, and we’ll fight for your rights to compensation in court.
Steps in the Litigation Process
The main steps in the litigation phase include:
- Filing a Complaint
Once you decide to file a lawsuit, your attorney will create a document called a complaint. The complaint contains the events leading up to the accident and identifies the negligent party and his insurance company as the defendants. Once the complaint is sent to the defendants, they must respond to it within a limited time frame.
- Discovery Phase
During the discovery phase, your Ohio personal injury lawyer and the defendant’s attorney will share information about the case. Both parties are required by law to participate by conducting depositions and written discovery.
After the discovery phase, a motion may be filed with the Court regarding a number of issues, including a motion requesting that some or all of the case be dismissed. A motion is a request to make a decision about the case before the trial. Motions are common if key evidence or facts are missing regarding the case.
Once the motions have been reviewed by the judge, your case will go to trial. At the trial, your attorney will present your case to a judge and/or jury. All of the information, including evidence and witness statements, will be presented on your behalf. At the conclusion of the trial, a verdict will be reached, and if the judge or jury decides in your favor, you will be awarded compensation.
