A settlement in the amount of $650,000 was received for the wrongful death of a college professor who died of breast cancer. The untimely death of this professor was argued to have been caused by the failure of the radiologist to timely diagnose the breast cancer in two previous mammograms that dated back more than 2 years prior to the client’s death. The case was resolved one day prior to trial.During the period of litigation the prior Mammography of the client was assembled and reviewed by an expert radiologist who specialized in interpreting mammograms. Based upon the expert’s review it was discovered that the client’s past 2 mammograms had demonstrated a density which later revealed itself as untreatable breast cancer. In addition, an expert Oncologist and Pathologist were asked to review the clients medical charts and pathology. The review of the Pathology, in particular, revealed that had the client’s earlier mammogram been properly interpreted she would have been able to be cured of the breast cancer that eventual caused her untimely death.
