Case involving failure to timely diagnose lung cancer. Plaintiff claimed that his wife had chest x-rays on April 26, 1989 and January 2, 1990 which demonstrated the presence of a treatable cancerous lesion. Defendant’s experts claimed that the x-rays were not misread and that, in either case, the lung cancerous lesion was not treatable in 1989 and she would have died anyway. Decedent’s husband did not seek legal assistance until more than one year after his wife learned of her condition and, therefore, there was no survivor action claim, only wrongful death.
