On, or about February 11, 1994, the decedent was traveling as a passenger in a vehicle on U.S. Highway 50 in a westbound direction. Approximately 3/10 of a mile west of Mile Post No. 26, in the Township of Rome, County of Athens, State of Ohio, an eastbound vehicle being operated by the Defendant collided with the vehicle in which the decedent was a passenger. As a direct and proximate result, the decedent suffered serious physical and emotional injuries, including fear, shock, and terror of his impending death, and then died.
