Plaintiff baby was taken by her mother to defendant pediatrician presenting with fever and lethargy. Defendant did a CBC which was normal. Mother was instructed to observe. A few hours later, fever spiked to 103.9. Defendant was called but was unconcerned. The following day, a diagnosis of meningitis was made. The baby suffered bilateral hearing loss. The defense claimed that the standard of care was met because the baby looked well in the defendant’s office.
