Our 7-year-old client was shopping at PetSmart with his mother. Defendant dog owner brought her dog into the store on a leash, in conformance with store policy, but then tied the dog to a display shelf. Store employees saw this and failed to remind owner to maintain “control” over her dog. Plaintiff went to pet dog, was bitten, and sustained facial scars. The dog owner’s insurance company immediately paid its policy limits. The Defendant pet store argued that its store policy was safe and that the dog owner’s violation of the store policy was the proximate cause of the injury.
