The Plaintiff was working on the third level of scaffolding under the instruction of his employer. The scaffolding had been built in violation of industry standards without proper guard railing. The Plaintiff’s task for the day consisted of a co-worker sliding bricks down a wooden plank to the Plaintiff on the scaffolding to be stacked. At the time of the fall, the Plaintiff was carrying the plank and fell beneath the cross bracing of the scaffolding which was not protected by guardrails. Had guardrails been properly in place on the scaffolding, Plaintiff would not have fallen. The Plaintiff sustained multiple fractures as a result of the fall.
